1. Acceptance of Terms

By accepting a quotation, issuing a Purchase Order, signing a written agreement, or engaging the services of Beyond Painting Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Issuing a Purchase Order (PO) constitutes formal acceptance of the quotation and confirms agreement to all terms outlined herein.

A Purchase Order must be raised prior to works commencement.

Beyond Painting Services reserves the right to amend these Terms and Conditions at any time. Updated terms will apply to future quotations and agreements.

2. Description of Services

Beyond Painting Services provides professional residential and commercial painting services including but not limited to:

• Interior painting

• Exterior painting

• Residential and commercial repaints

• Surface preparation and minor repairs

• Decorative finishes

• Pressure cleaning and preparation works

All services are subject to availability and a written quotation.

3. Pricing

• All prices quoted are exclusive of GST unless otherwise stated.

• Quotations are valid for 30 days from date of issue.

• After 30 days, pricing may be reviewed and re-evaluated.

• Any changes to scope of works may result in revised pricing.

4. Payment Terms

Unless otherwise agreed in writing:

• 10% Deposit

• 40% Commencement Payment (labour & materials) payable upon issue of Purchase Order

• Remaining balance payable upon completion, unless progressive claims have been negotiated

Payments must be transferred to the designated bank account specified on the invoice.

Late payments may incur interest and recovery costs as permitted by law.

5. Progressive Claims

Where agreed between parties, progressive payments may be requested:

• Every 7 days, or

• At the start of each working week

Progress claims will be issued by Beyond Painting Services throughout the duration of the project.

6. Variations & Additional Works

This agreement is subject to modification.

If supplementary tasks, works, or materials are required that are not expressly included in the original quotation:

• Additional fees will be discussed and agreed upon prior to commencement

• Variations may affect project timelines

• Written confirmation of variation is required

7. Site Access & Client Responsibilities

The client agrees to:

• Provide safe and clear access to the work site

• Remove or secure personal belongings where necessary

• Ensure utilities (power/water) are available if required

Beyond Painting Services reserves the right to delay or suspend works if the site is unsafe or inaccessible.

8. Site Protection & Clean-Up

• All floors, furniture, and fixtures will be reasonably protected during works.

• A thorough clean-up of the work area will be conducted upon completion of the agreed scope.

Beyond Painting Services is not responsible for pre-existing damage or concealed defects.

9. Suspension of Works

Beyond Painting Services reserves the right, without notice, to halt works if:

• Payment terms are not met

• Site conditions are unsafe

• The client breaches these Terms

Works will resume only once issues are resolved.

10. Invoicing & Personal Responsibility

An invoice will be issued for services provided.

By accepting the quotation:

• The client agrees to pay all invoices in full

• The signatory acknowledges personal responsibility for payment

• Acceptance constitutes a Personal Guarantee

11. Continuing Guarantee

The Personal Guarantee is a continuing guarantee and shall not be discharged by:

• Any arrangement made by the company or partnership

• Insolvency of the company or partnership

• Any variations to the agreement

12. Recovery of Outstanding Accounts

If payment is overdue:

Beyond Painting Services may take further action to secure payment.

All recovery costs including:

• Debt collection commissions

• Legal fees

• Administrative costs

• Court fees

• Any incidental expenses

Will be added to the outstanding balance.

13. Retention of Title

Ownership of goods and services supplied remains the property of Beyond Painting Services until payment is made in full.

14. Workmanship & Warranty

All works are carried out with due care and skill in accordance with Australian Consumer Law.

Unless otherwise specified in writing:

• A standard workmanship warranty applies for a reasonable period under Australian law.

• Warranty does not cover:

  • Normal wear and tear

  • Structural movement or building defects

  • Water ingress or moisture issues

  • Damage caused by third parties

  • Lack of maintenance

15. Disclaimers

To the maximum extent permitted by law:

• We do not guarantee colour perception due to lighting and substrate conditions.

• We are not liable for hidden defects not reasonably identifiable prior to work commencing.

• We are not responsible for delays caused by weather, supplier shortages, or events beyond our control.

Nothing in these Terms excludes rights under Australian Consumer Law.

16. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect or consequential loss.

• Our total liability is limited to the amount paid for the relevant services.

• We are not liable for delays beyond our reasonable control.

17. Termination

Termination by Client

The client may cancel prior to commencement. Any costs incurred (materials, labour, scheduling) may be charged.

Termination by Beyond Painting Services

We may terminate or suspend works for:

• Non-payment

• Breach of terms

• Unsafe site conditions

Outstanding balances become immediately payable upon termination.

18. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

Any disputes shall be subject to the jurisdiction of the courts of New South Wales.

19. Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between the client and Beyond Painting Services and supersede any prior discussions or agreements.

CONFIRMATION OF ACCEPTANCE

Issuing a Purchase Order confirms:

• Acceptance of the quotation

• Agreement to all Terms and Conditions

• Authorisation for Beyond Painting Services to proceed

Quotation Valid: 30 Days
Ownership of goods remains with Beyond Painting Services until paid in full.
